These Terms and Conditions (“Agreement”) govern the relationship between Cinemagic Maker AI (“we”, “us”, “the Platform”) and you as a user (“you”, “the User”) when using our services through our website <\/b>https:\/\/app.cinemagicmaker.ai\/auth\/login.<\/b><\/a><\/p>

Please read these Terms carefully before using the Services. By using the Services, you agree to be fully bound by these Terms. If you do not agree to any of the Terms, please stop using the Platform immediately.<\/b><\/p>

1. Definition of Services<\/b><\/h2>

Cinemagic Maker AI is a platform that enables users to generate images and videos using artificial intelligence technologies. The Services include creating, enhancing, and digitally processing images and videos.<\/b><\/p>

2. Accounts and Usage<\/b><\/h2>
  • You must be 18 years of age or older to use the Platform.<\/b><\/li><\/ul>
    • The User bears full responsibility for all activity on their account, including any content created or uploaded through the Platform.<\/b><\/li><\/ul>
      • We reserve the right to suspend or close any user account at any time, for any reason, without prior notice.<\/b><\/li><\/ul>
        • Sharing an account with others is strictly prohibited; each user is allowed only one account.<\/b><\/li><\/ul>

          3. Intellectual Property Rights and Content Usage<\/b><\/h2>
          • All images and videos generated through the Platform are stored in our database, and the User has no right to request their deletion or removal.<\/b><\/li><\/ul>
            • We reserve the right to use all images and videos created by users for any commercial, creative, marketing, or research purposes without requiring the User’s permission or paying any financial compensation.<\/b><\/li><\/ul>
              • The User agrees to grant Cinemagic Maker AI a non-exclusive, perpetual, worldwide, irrevocable, royalty-free right to use the content generated through the Platform in any manner we deem appropriate.<\/b><\/li><\/ul>
                • The User may not object to or claim any financial compensation or intellectual property rights over the content generated through the Platform.<\/b><\/li><\/ul>

                  4. Usage Restrictions<\/b><\/h2>

                  The User is prohibited from:<\/b><\/p>

                  • Using the Platform to create or publish unlawful, offensive, or harmful content.<\/b><\/li><\/ul>
                    • Attempting to reverse engineer the system or tamper with the Services.<\/b><\/li><\/ul>
                      • Using the Services to produce content protected by copyright or to infringe the rights of others.<\/b><\/li><\/ul>
                        • Using the Platform to create content that violates local or international laws.<\/b><\/li><\/ul>

                          5. Disclaimer of Warranties<\/b><\/h2>

                            • We shall not be liable for any direct, indirect, or consequential losses or damages arising from your use of the Services.<\/b><\/li><\/ul>

                                6. Termination of Service<\/b><\/h2>

                                        8. Governing Law and Dispute Resolution<\/b><\/h2>

                                        This Agreement shall be governed by the laws of the State of Kuwait. Any disputes arising out of or in connection with this Agreement shall be settled through binding arbitration in Kuwait City, State of Kuwait. The arbitration shall be conducted in accordance with the rules of the Kuwait Commercial Arbitration Centre, and the language of arbitration shall be Arabic. The arbitration award shall be final and binding on both parties.<\/b><\/p>

                                        The User agrees to waive any right to bring a class action lawsuit against Cinemagic Maker AI.<\/b><\/p>

                                        9. Credits and Payment Policy<\/b><\/h2>

                                        9.1 Definition of Credits<\/b><\/h3>

                                        Credits (“Credits”) are prepaid digital units used to access and use the services and features of Cinemagic Maker AI. Credits constitute prepaid amounts for Platform services and have no monetary value outside the Platform.<\/b><\/p>

                                        9.2 Obtaining Credits<\/b><\/h3>

                                        The User may obtain Credits through the following methods:<\/b><\/p>

                                        • Direct Purchase: By purchasing Credit packages available on the Platform.<\/b><\/li><\/ul>
                                          • Subscriptions: Each monthly or annual subscription grants a specified amount of Credits based on the selected plan.<\/b><\/li><\/ul>
                                            • Promotional Credits: The Platform may grant free promotional Credits in special cases subject to terms and conditions determined by the Cinemagic Maker AI team.<\/b><\/li><\/ul>

                                              9.3 Credits Validity<\/b><\/h3>
                                              • Purchased Credits have a validity period determined solely by Cinemagic Maker AI at its own discretion. The Platform reserves the full right to modify this period at any time without prior notice, and the User has no right to object to any change in the validity period or to claim any compensation as a result.<\/b><\/li><\/ul>
                                                • Promotional Credits have their own expiry date determined upon issuance and may differ from the validity of purchased Credits.<\/b><\/li><\/ul>
                                                  • Unused Credits are not transferred to a new subscription cycle or subsequent period after their expiry.<\/b><\/li><\/ul>
                                                    • The Platform bears full responsibility for determining the expiry date of each balance, and the User must regularly monitor their balance.<\/b><\/li><\/ul>

                                                      9.4 Use of Credits<\/b><\/h3>
                                                      • Credits are consumed when using Platform features that require them, such as creating images and videos and any other future services.<\/b><\/li><\/ul>
                                                        • Cinemagic Maker AI reserves the right to determine and modify the Credit cost of each feature or service at any time without prior notice.<\/b><\/li><\/ul>
                                                          • The User has no right to object to the consumption of Credits.<\/b><\/li><\/ul>

                                                            9.5 No Refunds for Credits and Payments<\/b><\/h3>

                                                            All Credit or package purchases are final and non-refundable under any circumstances, including but not limited to:<\/b><\/p>

                                                            • Non-use of Credits or the package.<\/b><\/li><\/ul>
                                                              • Expiry of the validity period.<\/b><\/li><\/ul>
                                                                • Account closure.<\/b><\/li><\/ul>
                                                                  • Account suspension or closure by the Platform due to violation of the Terms.<\/b><\/li><\/ul>
                                                                    • Temporary or permanent suspension of the Services.<\/b><\/li><\/ul>

                                                                      Credits are not redeemable, transferable, or exchangeable for cash in any form. The User has no right to claim a refund of any amounts paid for Credits or packages, regardless of the reason.<\/b><\/p>

                                                                      9.6 Cancellation of Credits upon Account Closure<\/b><\/h3>

                                                                      Upon closure of the User’s account, whether at the User’s request or by the Platform’s decision, all remaining Credit balance shall be immediately cancelled without any financial compensation or refund. The Platform bears no liability to the User for Credits cancelled as a result of account closure.<\/b><\/p>

                                                                      9.7 Modification of Credit and Package Prices<\/b><\/h3>

                                                                      Cinemagic Maker AI reserves the full right to modify Credit and package prices at any time without prior notice. New prices shall apply to subsequent purchases immediately upon publication on the website and shall not affect previously purchased Credits.<\/b><\/p>

                                                                      9.8 Platform Protection from Misuse<\/b><\/h3>
                                                                      • The User is prohibited from attempting to obtain Credits through fraudulent or unlawful means, including exploiting technical errors or system vulnerabilities.<\/b><\/li><\/ul>
                                                                        • Upon discovery of any abusive or fraudulent use, the Platform reserves the right to cancel Credits obtained in such manner and close the account immediately without any compensation.<\/b><\/li><\/ul>
                                                                          • The Platform bears no liability for Credits consumed as a result of unauthorized access to the User’s account, and the User bears full responsibility for protecting their account credentials.<\/b><\/li><\/ul>

                                                                            9.9 Force Majeure and Service Interruption<\/b><\/h3>
                                                                            • In the event of complete or partial suspension of Services due to circumstances beyond the Platform’s control (such as natural disasters, governmental decisions, or major technical failures), the Platform is not obligated to compensate users for unused Credits.<\/b><\/li><\/ul>
                                                                              • Cinemagic Maker AI shall make reasonable efforts to maintain service continuity but does not guarantee availability at all times.<\/b><\/li><\/ul>

                                                                                10. Intellectual Property of the Platform<\/b><\/h2>

                                                                                All elements of the Platform, including design, source code, logos, names, algorithms, and artificial intelligence technologies, are the exclusive property of Cinemagic Maker AI or are licensed to it. The User may not copy, reproduce, distribute, or create derivative works from any part of the Platform in any form. Any unauthorized use constitutes an explicit violation of these Terms and subjects the User to legal liability.<\/b><\/p>

                                                                                11. Indemnification<\/b><\/h2>

                                                                                The User agrees to indemnify and hold harmless Cinemagic Maker AI, its management, employees, and agents from any claims, losses, damages, or legal costs arising from:<\/b><\/p>

                                                                                • The User’s violation of these Terms and Conditions.<\/b><\/li><\/ul>
                                                                                  • Content created or uploaded by the User through the Platform.<\/b><\/li><\/ul>
                                                                                    • The User’s infringement of any third party’s rights, including intellectual property rights.<\/b><\/li><\/ul>
                                                                                      • The User’s use of the Platform in violation of local or international laws.<\/b><\/li><\/ul>
                                                                                        • Any dispute arising between the User and a third party due to the User’s use of the Platform.<\/b><\/li><\/ul>

                                                                                          12. Third-Party Links<\/b><\/h2>

                                                                                          The Platform may contain links to third-party websites or services. These links are provided solely for the User’s convenience and do not imply that Cinemagic Maker AI endorses or bears any responsibility for the content, services, or privacy policies of those websites. The User uses these links at their own personal risk, and Cinemagic Maker AI’s Terms cease to apply upon the User leaving the Platform.<\/b><\/p>

                                                                                          13. Force Majeure<\/b><\/h2>

                                                                                          Cinemagic Maker AI shall not be liable for any delay, interruption, or failure in providing the Services if caused by circumstances beyond its control, including but not limited to: natural disasters, governmental or legislative decisions, cyberattacks, internet outages, network failures, disruption of technical service providers, or any other exceptional circumstances. In such cases, the User has no right to claim any financial compensation.<\/b><\/p>

                                                                                          14. Electronic Communications<\/b><\/h2>

                                                                                          The User agrees to receive all notices, updates, and communications relating to their account or these Terms via the email address registered in their account. Such electronic notices shall have full legal validity and shall be binding. The User bears full responsibility for maintaining the accuracy of their registered email address and updating it as needed. Sending a notice to the registered email shall constitute valid notice even if the User has not read it.<\/b><\/p>

                                                                                          15. Assignment<\/b><\/h2>

                                                                                          The User may not assign their account, rights, or obligations under these Terms to any third party without obtaining prior written consent from Cinemagic Maker AI. Conversely, the Company reserves the right to assign or transfer these Terms in whole or in part to any third party, including in cases of merger, acquisition, or sale of assets, without requiring the User’s consent.<\/b><\/p>

                                                                                          16. Severability and Waiver<\/b><\/h2>

                                                                                          If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be deemed severed from the remaining Terms without affecting the validity of the remaining provisions. Cinemagic Maker AI’s failure to exercise any of its rights at any given time shall not be deemed a waiver of such right in the future.<\/b><\/p>

                                                                                          17. Entire Agreement<\/b><\/h2>

                                                                                          These Terms and Conditions constitute the complete and final agreement between the User and Cinemagic Maker AI with respect to the use of the Platform and supersede all prior agreements or understandings, whether oral or written.<\/b><\/p>

                                                                                          18. User Conduct and Prohibited Activities<\/b><\/h2>

                                                                                          18.1 Acceptable Use<\/b><\/h3>

                                                                                          The User agrees to use the Platform in a lawful and ethical manner consistent with these Terms and Conditions and applicable local and international laws.<\/b><\/p>

                                                                                          18.2 Explicit Prohibitions<\/b><\/h3>

                                                                                          The User is prohibited from doing any of the following, and any violation entitles Cinemagic Maker AI to close the account immediately without any compensation:<\/b><\/p>

                                                                                          • Unlawful Content: Creating, publishing, or distributing any content that is unlawful, offensive, defamatory, threatening, or infringes the rights of others.<\/b><\/li><\/ul>
                                                                                            • Impersonation: Pretending to be another person or an employee of Cinemagic Maker AI or any other entity.<\/b><\/li><\/ul>
                                                                                              • Scraping and Automated Extraction: Using any automated tools or software to extract data or content from the Platform without prior written permission.<\/b><\/li><\/ul>
                                                                                                • System Damage: Any attempt to hack, disable, or introduce viruses or malicious software into the Platform.<\/b><\/li><\/ul>
                                                                                                  • Reverse Engineering: Attempting to decrypt, disassemble, or reverse engineer any part of the Platform’s technologies or AI models.<\/b><\/li><\/ul>
                                                                                                    • Unauthorized Commercial Use: Reselling, leasing, or distributing the Platform’s services without obtaining prior written consent from the Company.<\/b><\/li><\/ul>
                                                                                                      • Content Harmful to Minors: Creating any content that exploits or harms minors in any way.<\/b><\/li><\/ul>
                                                                                                        • Credit System Manipulation: Any attempt to manipulate or fraudulently obtain Credits through illegitimate means.<\/b><\/li><\/ul>

                                                                                                          18.3 Liability for Violations<\/b><\/h3>

                                                                                                          Full and exclusive responsibility for any violation of the above provisions rests solely with the User. Cinemagic Maker AI bears no legal or financial liability arising from the User’s violating conduct, and the Company reserves the right to take necessary legal action including seeking full compensation for any damages incurred.<\/b><\/p>

                                                                                                          19. Content Monitoring and Oversight<\/b><\/h2>

                                                                                                          19.1 Right to Monitor<\/b><\/h3>

                                                                                                          Cinemagic Maker AI reserves the full right, without any obligation, to monitor all content created or uploaded through the Platform at any time and by any means it deems appropriate. By using the Platform, you expressly and irrevocably consent to such monitoring.<\/b><\/p>

                                                                                                          19.2 Powers of Action<\/b><\/h3>

                                                                                                          Cinemagic Maker AI reserves the right, without any liability to the User, to:<\/b><\/p>

                                                                                                          • Remove or refuse to process any content at any time without prior notice.<\/b><\/li><\/ul>
                                                                                                            • Immediately suspend or close an account upon discovery of any violating content.<\/b><\/li><\/ul>
                                                                                                              • Retain violating content as legal evidence when necessary.<\/b><\/li><\/ul>
                                                                                                                • Disclose User data to competent legal authorities upon request or upon suspicion of unlawful activity.<\/b><\/li><\/ul>

                                                                                                                  19.3 Disclaimer of Liability for Content<\/b><\/h3>

                                                                                                                  Cinemagic Maker AI bears no responsibility for any content created by users, and any damage resulting from such content rests solely with the User. The Platform is not obligated to proactively review all content, and its failure to discover violating content does not exempt the User from liability.<\/b><\/p>

                                                                                                                  20. Intellectual Property Infringement Claims<\/b><\/h2>

                                                                                                                  20.1 Protection Policy<\/b><\/h3>

                                                                                                                  Cinemagic Maker AI respects intellectual property rights and takes a strict stance against any infringement. Accounts of users who repeatedly infringe intellectual property rights shall be permanently closed without any compensation.<\/b><\/p>

                                                                                                                  20.2 Filing a Complaint<\/b><\/h3>

                                                                                                                  If you believe that content on the Platform infringes your intellectual property rights, please submit a formal notice including:<\/b><\/p>

                                                                                                                  • Your full name, details, and contact information.<\/b><\/li><\/ul>
                                                                                                                    • A clear description of the content you claim has been infringed.<\/b><\/li><\/ul>
                                                                                                                      • Identification of the location of the allegedly infringing content on the Platform.<\/b><\/li><\/ul>
                                                                                                                        • A written statement that you believe in good faith that the use is not authorized.<\/b><\/li><\/ul>
                                                                                                                          • Your electronic or written signature along with an acknowledgment of the accuracy of the information provided.<\/b><\/li><\/ul>

                                                                                                                            20.3 Platform Protection from Malicious Complaints<\/b><\/h3>

                                                                                                                            Any intellectual property infringement complaint that is found to be malicious or misleading shall subject its submitter to full legal liability before Cinemagic Maker AI and the right to claim compensation for any damages suffered by the Platform or the complained-against User as a result.<\/b><\/p>

                                                                                                                            20.4 Platform Procedures<\/b><\/h3>

                                                                                                                            Upon receipt of a credible complaint, Cinemagic Maker AI reserves the right to immediately remove the complained-about content without reverting to the User and to close the account in case of repeated violations, all without any liability to the User for such action.<\/b><\/p>

                                                                                                                            21. Minors and Child Protection<\/b><\/h2>

                                                                                                                            21.1 Prohibition of Use<\/b><\/h3>

                                                                                                                            The Platform is exclusively intended for users who have completed 18 years of age. Use of the Platform by minors or allowing them access is strictly prohibited.<\/b><\/p>

                                                                                                                            21.2 User Responsibility<\/b><\/h3>

                                                                                                                            The User bears full and exclusive responsibility for preventing minors from accessing their account or using the Platform through it. Any use by a minor through a user’s account constitutes an explicit violation of these Terms and full responsibility rests solely with the User.<\/b><\/p>

                                                                                                                            21.3 Platform Protection<\/b><\/h3>

                                                                                                                            Cinemagic Maker AI bears no legal or moral responsibility arising from a minor’s access to the Platform through an adult user’s account, and reserves its full right to take legal action against the responsible User and close their account immediately without any compensation.<\/b><\/p>

                                                                                                                            21.4 Content Involving Minors<\/b><\/h3>

                                                                                                                            Creating any content involving minors in any offensive or inappropriate manner is strictly prohibited. Any violation of this provision exposes the User to immediate legal accountability and shall be reported to the competent authorities.<\/b><\/p>

                                                                                                                            22. Privacy Policy and Data Protection<\/b><\/h2>

                                                                                                                            22.1 Acknowledgment of Privacy Policy<\/b><\/h3>

                                                                                                                            By using the Platform, the User acknowledges having read and agreed to Cinemagic Maker AI’s Privacy Policy. The Privacy Policy is an integral part of these Terms and Conditions and complements them. In the event of any conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy shall prevail.<\/b><\/p>

                                                                                                                                      Cinemagic Maker AI reserves the right to use User data for the following purposes without requiring additional permission:<\/b><\/p>

                                                                                                                                                              Subject to the provisions of Section 3 of these Terms, the User may contact the Platform to inquire about their personal data. Cinemagic Maker AI reserves the full right to determine the extent of its response to such requests in accordance with the adopted Privacy Policy and applicable local laws in the State of Kuwait.<\/b><\/p>

                                                                                                                                                              22.7 Cookies<\/b><\/h3>

                                                                                                                                                              The Platform uses cookies and similar technologies to enhance user experience and analyze usage. By using the Platform, the User expressly consents to the use of such files in accordance with the Privacy Policy. The User has no right to claim any compensation for data collected through these technologies.<\/b><\/p>

Credits and Payment Policy9.1 Definition of CreditsCredits ("Credits") are prepaid digital units used to access and use the services and features of Cinemagic Maker AI. Credits constitute prepaid amounts for Platform services and have no monetary value outside the Platform.9.2 Obtaining CreditsThe User may obtain Credits through the following methods:Direct Purchase: By purchasing Credit packages available on the Platform.Subscriptions: Each monthly or annual subscription grants a specified amount of Credits based on the selected plan.Promotional Credits: The Platform may grant free promotional Credits in special cases subject to terms and conditions determined by the Cinemagic Maker AI team.9.3 Credits ValidityPurchased Credits have a validity period determined solely by Cinemagic Maker AI at its own discretion. The Platform reserves the full right to modify this period at any time without prior notice, and the User has no right to object to any change in the validity period or to claim any compensation as a result.Promotional Credits have their own expiry date determined upon issuance and may differ from the validity of purchased Credits.Unused Credits are not transferred to a new subscription cycle or subsequent period after their expiry.The Platform bears full responsibility for determining the expiry date of each balance, and the User must regularly monitor their balance.9.4 Use of CreditsCredits are consumed when using Platform features that require them, such as creating images and videos and any other future services.Cinemagic Maker AI reserves the right to determine and modify the Credit cost of each feature or service at any time without prior notice.The User has no right to object to the consumption of Credits.9.5 No Refunds for Credits and PaymentsAll Credit or package purchases are final and non-refundable under any circumstances, including but not limited to:Non-use of Credits or the package.Expiry of the validity period.Account closure.Account suspension or closure by the Platform due to violation of the Terms.Temporary or permanent suspension of the Services.Credits are not redeemable, transferable, or exchangeable for cash in any form. The User has no right to claim a refund of any amounts paid for Credits or packages, regardless of the reason.9.6 Cancellation of Credits upon Account ClosureUpon closure of the User's account, whether at the User's request or by the Platform's decision, all remaining Credit balance shall be immediately cancelled without any financial compensation or refund. The Platform bears no liability to the User for Credits cancelled as a result of account closure.9.7 Modification of Credit and Package PricesCinemagic Maker AI reserves the full right to modify Credit and package prices at any time without prior notice. New prices shall apply to subsequent purchases immediately upon publication on the website and shall not affect previously purchased Credits.9.8 Platform Protection from MisuseThe User is prohibited from attempting to obtain Credits through fraudulent or unlawful means, including exploiting technical errors or system vulnerabilities.Upon discovery of any abusive or fraudulent use, the Platform reserves the right to cancel Credits obtained in such manner and close the account immediately without any compensation.The Platform bears no liability for Credits consumed as a result of unauthorized access to the User's account, and the User bears full responsibility for protecting their account credentials.9.9 Force Majeure and Service InterruptionIn the event of complete or partial suspension of Services due to circumstances beyond the Platform's control (such as natural disasters, governmental decisions, or major technical failures), the Platform is not obligated to compensate users for unused Credits.Cinemagic Maker AI shall make reasonable efforts to maintain service continuity but does not guarantee availability at all times.10. Intellectual Property of the PlatformAll elements of the Platform, including design, source code, logos, names, algorithms, and artificial intelligence technologies, are the exclusive property of Cinemagic Maker AI or are licensed to it. The User may not copy, reproduce, distribute, or create derivative works from any part of the Platform in any form. Force MajeureCinemagic Maker AI shall not be liable for any delay, interruption, or failure in providing the Services if caused by circumstances beyond its control, including but not limited to: natural disasters, governmental or legislative decisions, cyberattacks, internet outages, network failures, disruption of technical service providers, or any other exceptional circumstances. In such cases, the User has no right to claim any financial compensation.14. Electronic CommunicationsThe User agrees to receive all notices, updates, and communications relating to their account or these Terms via the email address registered in their account. Such electronic notices shall have full legal validity and shall be binding. The User bears full responsibility for maintaining the accuracy of their registered email address and updating it as needed. Sending a notice to the registered email shall constitute valid notice even if the User has not read it.15. AssignmentThe User may not assign their account, rights, or obligations under these Terms to any third party without obtaining prior written consent from Cinemagic Maker AI. Conversely, the Company reserves the right to assign or transfer these Terms in whole or in part to any third party, including in cases of merger, acquisition, or sale of assets, without requiring the User's consent.16. User Conduct and Prohibited Activities18.1 Acceptable UseThe User agrees to use the Platform in a lawful and ethical manner consistent with these Terms and Conditions and applicable local and international laws.18.2 Explicit ProhibitionsThe User is prohibited from doing any of the following, and any violation entitles Cinemagic Maker AI to close the account immediately without any compensation:Unlawful Content: Creating, publishing, or distributing any content that is unlawful, offensive, defamatory, threatening, or infringes the rights of others.Impersonation: Pretending to be another person or an employee of Cinemagic Maker AI or any other entity.Scraping and Automated Extraction: Using any automated tools or software to extract data or content from the Platform without prior written permission.System Damage: Any attempt to hack, disable, or introduce viruses or malicious software into the Platform.Reverse Engineering: Attempting to decrypt, disassemble, or reverse engineer any part of the Platform's technologies or AI models.Unauthorized Commercial Use: Reselling, leasing, or distributing the Platform's services without obtaining prior written consent from the Company.Content Harmful to Minors: Creating any content that exploits or harms minors in any way.Credit System Manipulation: Any attempt to manipulate or fraudulently obtain Credits through illegitimate means.18.3 Liability for ViolationsFull and exclusive responsibility for any violation of the above provisions rests solely with the User. Cinemagic Maker AI bears no legal or financial liability arising from the User's violating conduct, and the Company reserves the right to take necessary legal action including seeking full compensation for any damages incurred.19. Content Monitoring and Oversight19.1 Right to MonitorCinemagic Maker AI reserves the full right, without any obligation, to monitor all content created or uploaded through the Platform at any time and by any means it deems appropriate. By using the Platform, you expressly and irrevocably consent to such monitoring.19.2 Powers of ActionCinemagic Maker AI reserves the right, without any liability to the User, to:Remove or refuse to process any content at any time without prior notice.Immediately suspend or close an account upon discovery of any violating content.Retain violating content as legal evidence when necessary.Disclose User data to competent legal authorities upon request or upon suspicion of unlawful activity.19.3 Disclaimer of Liability for ContentCinemagic Maker AI bears no responsibility for any content created by users, and any damage resulting from such content rests solely with the User. The Platform is not obligated to proactively review all content, and its failure to discover violating content does not exempt the User from liability.20. Intellectual Property Infringement Claims20.1 Protection PolicyCinemagic Maker AI respects intellectual property rights and takes a strict stance against any infringement. Accounts of users who repeatedly infringe intellectual property rights shall be permanently closed without any compensation.20.2 Filing a ComplaintIf you believe that content on the Platform infringes your intellectual property rights, please submit a formal notice including:Your full name, details, and contact information.A clear description of the content you claim has been infringed.Identification of the location of the allegedly infringing content on the Platform.A written statement that you believe in good faith that the use is not authorized.Your electronic or written signature along with an acknowledgment of the accuracy of the information provided.20.3 Platform Protection from Malicious ComplaintsAny intellectual property infringement complaint that is found to be malicious or misleading shall subject its submitter to full legal liability before Cinemagic Maker AI and the right to claim compensation for any damages suffered by the Platform or the complained-against User as a result.20.4 Platform ProceduresUpon receipt of a credible complaint, Cinemagic Maker AI reserves the right to immediately remove the complained-about content without reverting to the User and to close the account in case of repeated violations, all without any liability to the User for such action.21. Use of the Platform by minors or allowing them access is strictly prohibited.21.2 User ResponsibilityThe User bears full and exclusive responsibility for preventing minors from accessing their account or using the Platform through it. Any use by a minor through a user's account constitutes an explicit violation of these Terms and full responsibility rests solely with the User.21.3 Platform ProtectionCinemagic Maker AI bears no legal or moral responsibility arising from a minor's access to the Platform through an adult user's account, and reserves its full right to take legal action against the responsible User and close their account immediately without any compensation.21.4 Content Involving MinorsCreating any content involving minors in any offensive or inappropriate manner is strictly prohibited. Any violation of this provision exposes the User to immediate legal accountability and shall be reported to the competent authorities.22. Privacy Policy and Data Protection22.1 Acknowledgment of Privacy PolicyBy using the Platform, the User acknowledges having read and agreed to Cinemagic Maker AI's Privacy Policy. Sending a notice to the registered email shall constitute valid notice even if the User has not read it.15. AssignmentThe User may not assign their account, rights, or obligations under these Terms to any third party without obtaining prior written consent from Cinemagic Maker AI. Conversely, the Company reserves the right to assign or transfer these Terms in whole or in part to any third party, including in cases of merger, acquisition, or sale of assets, without requiring the User's consent.16. Accounts of users who repeatedly infringe intellectual property rights shall be permanently closed without any compensation.20.2 Filing a ComplaintIf you believe that content on the Platform infringes your intellectual property rights, please submit a formal notice including:Your full name, details, and contact information.A clear description of the content you claim has been infringed.Identification of the location of the allegedly infringing content on the Platform.A written statement that you believe in good faith that the use is not authorized.Your electronic or written signature along with an acknowledgment of the accuracy of the information provided.20.3 Platform Protection from Malicious ComplaintsAny intellectual property infringement complaint that is found to be malicious or misleading shall subject its submitter to full legal liability before Cinemagic Maker AI and the right to claim compensation for any damages suffered by the Platform or the complained-against User as a result.20.4 Platform ProceduresUpon receipt of a credible complaint, Cinemagic Maker AI reserves the right to immediately remove the complained-about content without reverting to the User and to close the account in case of repeated violations, all without any liability to the User for such action.21. Use of the Platform by minors or allowing them access is strictly prohibited.21.2 User ResponsibilityThe User bears full and exclusive responsibility for preventing minors from accessing their account or using the Platform through it. Any use by a minor through a user's account constitutes an explicit violation of these Terms and full responsibility rests solely with the User.21.3 Platform ProtectionCinemagic Maker AI bears no legal or moral responsibility arising from a minor's access to the Platform through an adult user's account, and reserves its full right to take legal action against the responsible User and close their account immediately without any compensation.21.4 Content Involving MinorsCreating any content involving minors in any offensive or inappropriate manner is strictly prohibited. Any violation of this provision exposes the User to immediate legal accountability and shall be reported to the competent authorities.22. Privacy Policy and Data Protection22.1 Acknowledgment of Privacy PolicyBy using the Platform, the User acknowledges having read and agreed to Cinemagic Maker AI's Privacy Policy. Credits constitute prepaid amounts for Platform services and have no monetary value outside the Platform.9.2 Obtaining CreditsThe User may obtain Credits through the following methods:Direct Purchase: By purchasing Credit packages available on the Platform.Subscriptions: Each monthly or annual subscription grants a specified amount of Credits based on the selected plan.Promotional Credits: The Platform may grant free promotional Credits in special cases subject to terms and conditions determined by the Cinemagic Maker AI team.9.3 Credits ValidityPurchased Credits have a validity period determined solely by Cinemagic Maker AI at its own discretion. The Platform reserves the full right to modify this period at any time without prior notice, and the User has no right to object to any change in the validity period or to claim any compensation as a result.Promotional Credits have their own expiry date determined upon issuance and may differ from the validity of purchased Credits.Unused Credits are not transferred to a new subscription cycle or subsequent period after their expiry.The Platform bears full responsibility for determining the expiry date of each balance, and the User must regularly monitor their balance.9.4 Use of CreditsCredits are consumed when using Platform features that require them, such as creating images and videos and any other future services.Cinemagic Maker AI reserves the right to determine and modify the Credit cost of each feature or service at any time without prior notice.The User has no right to object to the consumption of Credits.9.5 No Refunds for Credits and PaymentsAll Credit or package purchases are final and non-refundable under any circumstances, including but not limited to:Non-use of Credits or the package.Expiry of the validity period.Account closure.Account suspension or closure by the Platform due to violation of the Terms.Temporary or permanent suspension of the Services.Credits are not redeemable, transferable, or exchangeable for cash in any form. Accounts of users who repeatedly infringe intellectual property rights shall be permanently closed without any compensation.20.2 Filing a ComplaintIf you believe that content on the Platform infringes your intellectual property rights, please submit a formal notice including:Your full name, details, and contact information.A clear description of the content you claim has been infringed.Identification of the location of the allegedly infringing content on the Platform.A written statement that you believe in good faith that the use is not authorized.Your electronic or written signature along with an acknowledgment of the accuracy of the information provided.20.3 Platform Protection from Malicious ComplaintsAny intellectual property infringement complaint that is found to be malicious or misleading shall subject its submitter to full legal liability before Cinemagic Maker AI and the right to claim compensation for any damages suffered by the Platform or the complained-against User as a result.20.4 Platform ProceduresUpon receipt of a credible complaint, Cinemagic Maker AI reserves the right to immediately remove the complained-about content without reverting to the User and to close the account in case of repeated violations, all without any liability to the User for such action.21. Minors and Child Protection21.1 Prohibition of UseThe Platform is exclusively intended for users who have completed 18 years of age. Use of the Platform by minors or allowing them access is strictly prohibited.21.2 User ResponsibilityThe User bears full and exclusive responsibility for preventing minors from accessing their account or using the Platform through it. Any use by a minor through a user's account constitutes an explicit violation of these Terms and full responsibility rests solely with the User.21.3 Platform ProtectionCinemagic Maker AI bears no legal or moral responsibility arising from a minor's access to the Platform through an adult user's account, and reserves its full right to take legal action against the responsible User and close their account immediately without any compensation.21.4 Content Involving MinorsCreating any content involving minors in any offensive or inappropriate manner is strictly prohibited. Any violation of this provision exposes the User to immediate legal accountability and shall be reported to the competent authorities.22. Privacy Policy and Data Protection22.1 Acknowledgment of Privacy PolicyBy using the Platform, the User acknowledges having read and agreed to Cinemagic Maker AI's Privacy Policy. The Privacy Policy is an integral part of these Terms and Conditions and complements them. In the event of any conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy shall prevail.22.2 Data Collection and UseCinemagic Maker AI reserves the right to collect, process, and use User data, including but not limited to:Registration and account data.Usage and activity data on the Platform.Content created or uploaded through the Platform.Technical data such as IP address, device type, and browser.Payment and financial transaction data.The User expressly consents to such collection and processing upon using the Platform.22.3 Purposes of Data UseCinemagic Maker AI reserves the right to use User data for the following purposes without requiring additional permission:Operating and improving the Platform's services.Developing and training artificial intelligence models.Marketing and promotional purposes.Research and analytical purposes.Compliance with legal and regulatory requirements.22.4 Sharing Data with Third PartiesCinemagic Maker AI reserves the right to share User data with third parties in the following cases, without any liability to the User:Technical service and infrastructure providers.Legal and governmental authorities upon request or necessity.Business partners in accordance with the adopted Privacy Policy.In cases of merger, acquisition, or sale of the Company's assets.22.5 Data Security and Limitation of LiabilityCinemagic Maker AI shall make reasonable efforts to protect User data; however, it does not guarantee absolute protection against any breach or unauthorized access. The Platform bears no liability for:Any security breach resulting from circumstances beyond its control.Any data voluntarily disclosed by the User to third parties.Any damage resulting from the User's negligence in protecting their account credentials.22.6 Limited User Rights Regarding DataSubject to the provisions of Section 3 of these Terms, the User may contact the Platform to inquire about their personal data. Cinemagic Maker AI reserves the full right to determine the extent of its response to such requests in accordance with the adopted Privacy Policy and applicable local laws in the State of Kuwait.22.7 CookiesThe Platform uses cookies and similar technologies to enhance user experience and analyze usage. By using the Platform, the User expressly consents to the use of such files in accordance with the Privacy Policy. The User has no right to claim any compensation for data collected through these technologies.22.8 Amendments to the Privacy PolicyCinemagic Maker AI reserves the right to amend the Privacy Policy at any time. The User will be notified of any material amendments via the registered email address or through a notice on the Platform. The User's continued use of the Platform after publication of amendments shall be deemed implied consent to the new Policy without the need for explicit consent.22.9 Third-Party AnalyticsBy using the Platform, you consent to the collection and processing of usage data by third-party analytics tools, including Amplitude, as detailed in our Privacy Policy.
